DMCA & Copyright Policy

Linkyhost respects the intellectual property rights of others and expects users of its services to do the same. We respond to notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (DMCA), the Australian Copyright Act 1968 (Cth), and other applicable intellectual property laws.

Filing a DMCA Takedown Notice
If you believe that content hosted on Linkyhost infringes your copyright, you may submit a takedown notice via our online form or by emailing support@linkyhost.com.
Your notice must include all of the following:
- Identification of the copyrighted work — a description of the work you claim has been infringed, or a link to the original work.
- Identification of the infringing material — the URL(s) on Linkyhost where the allegedly infringing material is located.
- Your contact information — your full name, email address, and mailing address.
- Good-faith statement — a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement — a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on behalf of the owner.
- Signature — your physical or electronic signature.
How We Process Notices
- We review the notice for completeness and validity.
- If valid, we expeditiously disable access to the allegedly infringing material.
- We notify the user who uploaded the content and provide them with a copy of the notice.
- The user may submit a counter-notification if they believe the takedown was made in error.
Counter-Notification
If you believe your content was removed in error or is not infringing, you may submit a counter-notification to support@linkyhost.com containing:
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, address, and phone number.
- A statement that you consent to the jurisdiction of the relevant court and will accept service of process from the person who filed the original notice.
- Your physical or electronic signature.
Upon receiving a valid counter-notification, we will forward it to the original claimant. If the claimant does not file a court action within 10–14 business days, we may restore the removed content.
Repeat Infringers
Linkyhost will terminate the accounts of users who are repeat infringers in appropriate circumstances. We maintain records of all DMCA notices and counter-notifications received.
Misrepresentation
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be subject to liability for damages.
